TASC

What is TASC?

"TASC," as it is generally known here in Arizona, is a random drug testing diversion program offered by the Maricopa County Attorney’s Office. The program is designed to give defendants facing drug possession charges the opportunity to get sober, maintain their sobriety, and hopefully develop the strength and skills to lead a drug free life. TASC is a not-for-profit organization that provides random drug testing, certified alcohol, drug, and mental health counseling, and it provides resources to those individuals who are ready to turn their life around.

Who qualifies for TASC?

Typically, TASC is available to first time drug offenders who are arrested with small amounts of marijuana, cocaine, methamphetamines, crack, or heroine. A defendant may not be eligible for TASC if they have a prior criminal history involving drug possession, or serious or violent crimes. A defendant’s eligibility to enter TASC is determined by the Maricopa County Attorney’s Office policies and the policies of TASC, Inc.

If I qualify for TASC, do I still need an attorney?

This is a question we get all the time and the answer is always, "yes." You should never go to court without the representation of a lawyer who is experienced at defending drug charges and experienced at getting their clients into the TASC program. Drug cases almost always result from the stopping of a car or person and a subsequent search. The significant majority of criminal defense constitutional law is based on searches and seizures. You need an attorney who knows how to handle sophisticated search and seizure issues so that they can evaluate your case and determine whether you should enter TASC or choose to fight the case because the government violate your rights. The attorneys at Shell & Nermyr PLLC, have successfully challenged search and seizure issues thoughout the state of Arizona, and they are current on all developments in the search and seizure area. Our firm, however, will not charge you thousands and thousands of dollars to go with you to court and assess the strengths and weakness of your case. Instead, we generally charge a low-affordable rate for attending court with you and assessing with you should enter TASC or fight the case. If you don't believe us, simply call four other law firms and see how many thousands of dollars they want to charge you. When you get done and have recovered from the sticker shock, call us at (480) 775-4800 and see how our professional team can help you.

How much does TASC cost?

Like most diversion programs, there is a fee to enter the TASC program. The fee ranges from several hundred dollars up to over $2000.00. There is also a fee for every drug test that is submitted. TASC splits the fee with the Maricopa County Attorney's Office Drug Fund.
